1. Agreement
By requesting a quote, clicking Order Now, or using any Xceed Connections cloud, hosting, or software service, you agree to these Terms of Use and our Acceptable Use Policy. If you do not agree, do not place an order.
2. Services
We provide cloud server rental and related services (including but not limited to Vicidial, softswitches, panels, streaming, VPN, CRM portals, and installation assistance) as described on our website. Specifications, locations, and monthly rates shown online are for guidance and may be updated without prior notice.
3. Orders & provisioning
- Orders are requests that become binding only after our confirmation and payment instructions (where applicable).
- Servers are allocated subject to availability of capacity, IP addresses, and the chosen cloud location.
- If a plan or location is unavailable, we may offer an alternative configuration or refund unused prepaid amounts related to that specific order.
- Delivery times depend on verification, payment clearance, and provider provisioning.
4. Billing
- Unless stated otherwise, cloud servers are billed on a monthly rental basis.
- Fees are generally non-refundable once a server has been provisioned, except where required by law or expressly agreed in writing.
- Non-payment or chargebacks may result in suspension or termination of service.
5. Customer responsibilities
- You are responsible for securing credentials, applications, data, backups, and compliance with applicable laws in your jurisdiction.
- Unmanaged services place configuration and maintenance responsibility on you unless a managed add-on is agreed.
- You must keep contact details accurate so we can reach you about abuse, billing, or security notices.
6. Acceptable Use Policy
You may not use our services to:
- Engage in illegal activity, fraud, phishing, or unauthorized access to systems.
- Distribute malware, spam, or unsolicited bulk communications in violation of law.
- Attack, scan, or disrupt networks (DDoS, brute force, etc.) except on systems you own and are authorized to test.
- Host or distribute content that infringes intellectual property or privacy rights.
- Mine cryptocurrency or run abusive high-load workloads without prior written approval.
- Resell or redistribute services in a way that violates provider or local regulations without authorization.
We may investigate suspected abuse and suspend or terminate services to protect our network, customers, and providers.
7. Fair use & network
Bandwidth, CPU, and disk usage must remain within the purchased plan and any fair-use guidelines. Sustained abuse that impacts other customers may require an upgrade or may lead to throttling or suspension.
8. Data & privacy
You retain ownership of your data. You are responsible for lawful processing of personal data stored on your servers. We process limited account and order information to deliver service and support. Do not store data on our systems that you are not legally entitled to process.
9. Security & firewalls
We may apply network firewalls and reasonable security controls. You remain responsible for application-level security, patches, and access policies on unmanaged servers.
10. Service changes & suspension
We may modify, suspend, or discontinue a service for maintenance, security, legal compliance, non-payment, or AUP violations. Where practical, we will provide notice for planned maintenance.
11. Limitation of liability
To the fullest extent permitted by law, Xceed Connections is not liable for indirect, incidental, or consequential damages, lost profits, or data loss. Our aggregate liability related to a service period is limited to fees paid for that service in the preceding one (1) month, except where liability cannot be limited by law.
12. No warranty beyond stated scope
Services are provided on a commercially reasonable basis. Third-party cloud providers, networks, and software may affect uptime. Availability commitments apply only where expressly stated in a written SLA.
13. Governing context
These terms are intended for professional cloud hosting customers. If any provision is held unenforceable, the remaining provisions continue in effect. We may update these terms; the version linked at the time of your order acceptance applies to that order.
